These Terms and Conditions (“Terms”) govern your access to and use of the Brunetti Classico mobile application (the “App”) provided by Brunetti Classico (“we”, “our”, or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to use the App. By using the App, you represent and warrant that you meet these requirements.

2. Account Registration

• To access certain features, you may be required to create an account. You agree to:
• Provide accurate, current, and complete information during registration.
• Maintain the security of your account and password.
• Accept responsibility for all activities that occur under your account.
  We reserve the right to suspend or terminate accounts if we suspect unauthorised use or breach of these Terms.

3. Ordering and Payment

Orders placed through the App are subject to availability and acceptance by us.

All prices are displayed in Australian Dollars (AUD) and include GST unless otherwise stated.

Payment must be made in full at the time of ordering using the payment options provided in the App.

Once an order is confirmed, it cannot be cancelled or modified. Refunds may only be granted in line with our Refund Policy [insert link if available].

We reserve the right to refuse or cancel any order, including in the case of errors in pricing or product availability.

4. Loyalty and Rewards Program

By using the App, you may be eligible to earn loyalty points or rewards (“Rewards”).

Rewards have no cash value and cannot be exchanged for cash.

Rewards are personal to your account and cannot be transferred, sold, or combined with another user’s account.

We reserve the right to change, suspend, or cancel the Rewards program (including points earned and redemption methods) at any time without notice.

Misuse of the Rewards program, including fraudulent or abusive activity, may result in loss of points and/or suspension of your account.

App points can be redeemed in-store only at a ratio of 25 points = $1. This is subject to change at any time without notice.

App points cannot be applied retroactively and the app barcode must be presented at the time of purchase to claim.

App points accumulate only via in store purchases and cannot be applied to purchases made through our website or 3rd party delivery apps.

5. Promotions and Offers

From time to time, we may offer promotional discounts, vouchers, or limited-time deals through the App. These are subject to their own terms and conditions and may be withdrawn or modified at any time. Unless otherwise specified:

• Only one promotion can be used per order.
• Promotions cannot be applied to previous purchases.

6. Intellectual Property

All content, features, and functionality within the App (including text, graphics, logos, product images, and software) are owned by or licensed to Brunetti Classico and are protected by intellectual property laws. You may not use our intellectual property without prior written consent.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. The privacy policy can be seen here

8. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.

Our total liability to you for any claim relating to the App will not exceed the amount you paid (if any) for the relevant order.
Nothing in these Terms limits your rights under the Australian Consumer Law.

9. Termination

We may suspend or terminate your access to the App at any time without notice if you breach these Terms or misuse the service. You may stop using the App at any time by deleting it from your device.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be effective once posted in the App or on our website. Continued use of the App constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

We cannot guarantee a date and time for delivery as this is dependent on the postal service. You will be provided a tracking number for your parcel. All chocolate and edible items shipped via Australia post will leave Brunetti Classico in perfect condition and be packed to the best of our abilities. Brunetti Classico cannot guarantee they will not melt or break while in transit. If you place this order, you acknowledge it is a risk and no refunds will be provided for damaged chocolate items.

We are committed to meeting your requested delivery time but cannot provide a guarantee. We will try our best to deliver as close as possible to the requested time.

If the premises is unattended at the time of delivery and there is no safe place to leave your order, it will be returned to Brunetti Classico where it will remain for collection. Second deliveries can be scheduled for the following day however you will need to pay the delivery fee again.

All orders must be inspected on pick up or upon delivery to confirm everything that was ordered is there. Any complaints regarding presentation must be expressed immediately before taking the cake.

Whilst we will endeavour to meet your dietary needs, our products are all produced & prepared on equipment that may contain small traces, residue or may have been in contact with allergenic substances and therefore we cannot give a guarantee that potential allergen transference has not occurred somewhere in the process. Therefore, we are unable to guarantee that any items sold are free from traces of allergens.

Any complaints regarding cake quality must be addressed within 24 hours and accompanied by the following:

• Clear, dated photos of the item in question
• Proof of purchase

Please be advised tiered and barrel cakes are made up of multiple cakes stacked on top of each other. For stability purposes, cake boards are positioned between each level of cake and straws/crosses are placed within the tiers. All products are food grade, and this is common practice when making tiered/barrel cakes.

Please note all our cakes are handmade and therefore may vary slightly from photo example. All cakes pictured may be different in proportions depending on sizing selected.

Unfortunately none of our cakes are nut free as everything is made in the same kitchen. There are however some cakes which do not contain nuts in the recipe. Our staff would be more than happy to help find a suitable option.

Unfortunatly none of our cakes are gluten free as everything is made in the same kitchen. There are however some cakes which do not contain flour in the recipe. These can be seen in the flourless tab on the celebration cakes page.

Our cookies and cream cheesecake does not contain egg in the recipe.

Our Torta di Arancia cake does not contain dairy in the recipe however there may be dairy in the chocolate decorations on top of the cake.

Yes, we only use halal gelatin so any cake that does not contain alcohol in the description will be halal.

Yes, please scroll up tot he top of this page and submit a cake enquiry with a photo example for a quote. all customised cakes require a minimum of 72 hours notice.

We have a large range of celebration cakes available in store for walk ins. Although we stock up our cakes daily, if you are wanting something specific we highly suggest you place an order so it wont be sold out when you arrive. All customised plaques require atleast 24 hours notice.

Some non perishable products can be posted via Australia post. Please see our merchandise interstate shipping page to see our range.

Yes, we deliver up to 50km from our Carlton store. Input your delivery address via the top bar and delivery will be quoted based on distance in the cart page. We may extend the 50km zone for larger orders such as wedding cakes however this will need to be approved and quoted on a case by case basis.
